Fees and Retainers
Legal fees are an important consideration when choosing a criminal defence lawyer. I believe in being upfront about how fees generally work so clients can make informed decisions without surprises.
Every case is different. The time, preparation, and complexity involved depend on the charge, the court, and the specific circumstances of the matter. For that reason, fees are discussed after I have had an opportunity to understand your situation.
How Criminal Defence Fees Are Structured
Most criminal defence matters are handled on a block fee retainer basis. This means a single fee is agreed upon to cover a defined portion of the case, such as representation up to a certain stage or outcome.
In some situations, particularly more complex matters, fees may be structured differently. If that applies to your case, this will be discussed clearly before any work begins.
What Factors Affect Legal Fees
Legal fees can vary based on several factors, including:
- The nature and seriousness of the charge
- Whether the matter is summary or indictable
- The amount of preparation required
- The number of court appearances involved
- Whether the case proceeds to trial
I take the time to explain how these factors apply to your case so you understand what is involved and why.
Payment and Flexibility
I understand that legal issues often arise unexpectedly. In appropriate cases, flexible payment arrangements may be available. Any payment terms are discussed in advance and confirmed as part of the retainer agreement.
Legal Aid Ontario
I accept Legal Aid Ontario certificates in select cases. Eligibility for Legal Aid is determined by Legal Aid Ontario based on financial criteria and the type of charge.
If you believe you may qualify, I can help explain the process and determine whether accepting a Legal Aid certificate may be an option in your case.
The Retainer Process
A lawyer client relationship begins only after a formal retainer agreement is in place. This typically includes:
- A discussion of the legal issues involved
- Confirmation that I am able to act
- Agreement on the scope of work and fees
- Signing of a written retainer agreement
This process helps ensure clarity and protects both the client and the lawyer.
Transparency and Communication
I believe clear communication around fees is part of good representation. Clients are encouraged to ask questions about fees, scope of work, and expectations before proceeding.
My goal is to ensure you understand how fees work and what representation will involve from the outset.
